As per Union Customs Code (Regulation (EU) No 952/2013), imports into Germany from outside the EU are subject to customs clearance. We provide the required EORI number (EU-wide) for smooth processing.

Import VAT (Einfuhrumsatzsteuer) applies at the German standard rate (currently 19%) unless goods are re-exported. We ensure correct classification under the Combined Nomenclature (CN code).

VAT Information

When we supply promotional products to German companies, all VAT handling is carried out strictly in line with European and German tax law. Under Article 138 of the VAT Directive 2006/112/EC, as well as §4 Nr. 1b and §6a of the German Umsatzsteuergesetz (UStG), an intra-Community supply is exempt from VAT provided that the goods are transported from one EU country to Germany, that the buyer provides a valid German VAT identification number (USt-IdNr.), and that the seller retains proof of the cross-border movement of goods. In these cases, we issue the invoice at 0% VAT and apply the reverse charge mechanism according to Article 196 of the VAT Directive and §13b UStG. This means that the German buyer, as the recipient of the supply, accounts for VAT directly in their own VAT return, while also being entitled to deduct it as input tax. The process is fully cash-neutral but ensures compliance with German tax authorities.

Every German VAT number provided to us is verified through the official VIES system (VAT Information Exchange System) in accordance with §18e UStG, and the result of that verification is documented. The invoice will always include the buyer’s VAT number, our EU VAT ID and EORI, and the legally required wording: “Steuerschuldnerschaft des Leistungsempfängers – Reverse Charge gemäß Art. 196 MwStSystRL / §13b UStG.” In cases where a buyer cannot provide a valid VAT number, or if the order is placed by a private individual rather than a business, VAT must be charged at our local supplier rate, for example 21% Spanish IVA or 20% Estonian VAT. In such cases the German client may normally reclaim this VAT through input tax deduction (Vorsteuerabzug) under §15 UStG.

For deliveries to Germany from outside the EU, for example from our Far East suppliers, import VAT (Einfuhrumsatzsteuer) applies in accordance with the Union Customs Code (Regulation (EU) No 952/2013) and German customs law. In these cases we ensure the correct tariff classification under the Combined Nomenclature (CN) and provide all necessary customs documentation using our EU EORI number, ensuring that German import VAT is correctly assessed and deductible where appropriate.

To preserve the VAT exemption for intra-EU deliveries, we maintain documentary proof of transport in compliance with Regulation (EU) 282/2011, Article 45a. This may include CMR consignment notes, signed delivery confirmations, and carrier tracking details. German tax authorities (Finanzamt) frequently audit this documentation, and we ensure that every shipment is properly supported to avoid any liability.
