Governing Law & Jurisdiction

All use of this website and all sales contracts are governed by the laws of the Republic of Estonia. Swish and Click OÜ also ensures that its terms and practices are compatible with relevant legal requirements in the United Kingdom and Switzerland for clients in those jurisdictions. Estonian law remains the governing law for all transactions, except to the extent that overriding mandatory laws of a user’s country (such as consumer protection regulations) may apply. Unless otherwise required by such mandatory law, any disputes arising from the use of this site or purchases will fall under the exclusive jurisdiction of the courts of Estonia (venue: Tallinn).

E-Commerce & Consumer Protection

Payments & Currency

We accept payments in multiple currencies (EUR - Euro, GBP - Great British Pound, USD - United States Dollar and CHF - Swiss Franc) to serve our global clientele. All payments must be made in the currency stated on your invoice and to the designated bank account specified for that currency. In accordance with EU payment regulations – notably the Payment Services Directive (PSD2, Directive (EU) 2015/2366) and the SEPA Regulation (EU No 260/2012) – we do not discriminate against payments from any valid bank account in the Single Euro Payments Area. In other words, no IBAN discrimination is practiced: we accept valid IBANs from any SEPA country for euro payments, as required by law.

We do not impose any surcharges on customers for using specific payment methods if such surcharges are prohibited by applicable law. In the event of late payment by a business client, Swish and Click OÜ reserves the right to charge interest on the overdue amount in line with the EU Late Payment Directive (2011/7/EU) and corresponding national legislation. Any such interest, if applied, will be at the statutory rate and will accrue from the date the payment became due until it is paid in full.

International Trade Compliance
